Rosa Events have been told that the American lawsuit claims that Samsung is ‘slavishly’ copying Apple's iPhone and iPad designs

The lawsuit was filed in the Northern District of California on Friday and seeks injunctions against Samsung, damages (both actual and punitive), and a finding that the infringement was wilful. Apple is bringing 16 claims against Samsung, including unjust enrichment, trademark infringement and 10 patent claims.

Samsung’s Galaxy Tab computer tablet slavishly copies a combination of several elements of the Apple Product Configuration Trade Dress,” Apple says in its suit. It notes, additionally, that Samsung’s tablet, like Apple’s, uses a similar rectangular design with rounded corners, similar black border and array of icons. That could indicate other tablet manufacturers, such as Motorola and HTC, can expect lawsuits in the future too.

This most recent lawsuit is part of a line of tribunals apple has launched against rival companies over claims of them ‘coping’ ideas and technology from them. Rosa Events read that in March, Apple sued HTC alleging patent infringement over the iPhone and in October 2010, Apple sued Motorola, saying its smartphones use Apple's intellectual property.

While the smartphone sector has all but caught up and even surpassed the iPhone, it is a different story when it comes to tablets. This latest patent infringement lawsuit is just one of hundreds currently before the courts in the States concerning technology companies – a number of which include Apple. The global smartphone market is expected to grow by 58% this year and Android is forecast to account for about 39% of it, according to research firm Gartner. The firm estimates that the tablet market is likely to quadruple to 70 million units in 2011. While the iPad will still dominate over the next three years, Gartner expects its market share to decline from 69% this year to 47% in 2015 as Android devices move in, apple are taking every step to try and ensure this doesn’t happen and are sure to show us over the next few years why they dominate the technology industry and we are no doubt going to witness them producing products to change the face of technology proving why they are on top.

Unless one side lands a killer blow in this case, Rosa Events and other consumers should be able to sit back, and enjoy the fruits of this fierce competition.
